Terms and conditions that apply in any interaction you have with The Oracle Paradigm™, theoracleparadigm.com or any affiliated entity are outlined below.

These terms and conditions are collectively and individually referred to as ‘Terms’. 

The Terms are binding as a customer of The Oracle Paradigm, theoracleparadigm.com and as a user of The Oracle Paradigm, and theoracleparadigm.com. The Oracle Paradigm, and theoracleparadigm.com reserves the right to change the Terms at any time. 

In the Terms, except to the extent that the context otherwise requires, a reference to “The Oracle Paradigm, theoracleparadigm.com”; “we”; “us”; or “our”, is a reference to the Australian company (ABN 19600282308) trading as The Oracle Paradigm and / or theoracleparadigm.com.

USE OF THE ORACLE PARADIGM™, THEORACLEPARADIGM.COM

Use of The Oracle Paradigm, and theoracleparadigm.com is subject to the Terms.  Access to The Oracle Paradigm, and theoracleparadigm.com is an acknowledgement that these Terms, as amended from time to time, have been read and accepted.

    Purchases may be made in-store or by electronic means, (i.e., via the Website, phone or email).  By placing an order using any of these means, you unconditionally agree to all Terms.

    Merchandise is offered for sale for personal non-commercial use and not for re-sale or any other application including commercial unless otherwise stipulated in a separate commercial agreement made outside of these Terms. Quantity restrictions apply.

    Orders are subject to acceptance and availability, and items in your shopping cart are not reserved and may be purchased by other customers.  The Oracle Paradigm, and theoracleparadigm.com will strive to notify you of your successful purchase by sending an order confirmation to the email address provided.  You are responsible to review this notification. If you do not receive the order confirmation, you remain responsible for payment. The Oracle Paradigm, and theoracleparadigm.com may reject an order if an item is out of stock or authorization for payment is not received.

    PRICING

    Prices are displayed in Australian Dollars or otherwise by automated currency exchange calculator displayed on the website, if available.

    Prices of merchandise may differ on The Oracle Paradigm, and theoracleparadigm.com and in-store.

    “Sale Price” refers to product on Sale typically at lower prices than previously listed.

    PAYMENT

    Once an order is placed you are obligated to pay The Oracle Paradigm, and theoracleparadigm.com, the total price and any delivery or insurance charges. International deliveries may incur additional fees or taxes and you are responsible for these.

    Payment can be made by any means available on The Oracle Paradigm, and theoracleparadigm.com.

    Orders will not ship until payment has been received.

    By ordering and making payment you agree you have not acted fraudulently or illegally.

    DELIVERY

    COMPENSATION

    Accessing The Oracle Paradigm, and theoracleparadigm.com confirms your agreement to fully compensate The Oracle Paradigm, and theoracleparadigm.com, its directors, officers, employees, affiliates, licensors, agents and suppliers immediately on demand, and hold The Oracle Paradigm, and theoracleparadigm.com harmless, against all liabilities, claims, expenses, damages and losses, including legal fees, arising from (i) any breach of the Terms, including but not limited to, any infringement by you of the copyrights or intellectual property rights of any third party; or (ii) the unauthorized use of your identity and credit card details for purchases on The Oracle Paradigm, and theoracleparadigm.com as a result of any action or inaction. 

    LIMITATION OF LIABILITY 

    The entire liability of The Oracle Paradigm, and theoracleparadigm.com in the Terms will not exceed the purchase price of the merchandise in question according to Australian Consumer Law.

    The Oracle Paradigm, and theoracleparadigm.com is not responsible for:

    1. any losses not easily predicted;
    2. any losses which are not a result of any action by The Oracle Paradigm, and theoracleparadigm.com;
    3. any other loss.

    The Oracle Paradigm, and theoracleparadigm.com is not responsible for an inability to satisfy any obligation under the Terms when the inability is because of any action out of our ability to control.

    Australian Consumer Law applies to your rights as a consumer.

    SEVERABILITY

    Any provision of the Terms which is illegal, void or unenforceable is only ineffective to the extent of that illegality, voidness or unenforceability, without invalidating the remaining provisions

    NO WAIVER

    If you breach the Terms and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the Terms.

    GOVERNING LAW

    The Terms are governed by and are to be construed according to the laws of South Australia, Australia.

    JURISDICTION

    You submit to and accept unconditionally the exclusive jurisdiction of the courts and appellate courts of South Australia, Australia with respect to any legal proceedings brought in relation to the Terms.
